WE'RE GOING TO TALK TONIGHT ABOUT THE ELECTRIC GRID, WHAT WE DO FOR YOU ALL, A LITTLE BIT ABOUT PARKER SPECIFICALLY, PLEASE INTERRUPT ME ANY TIME YOU WANT TO ASK ANY QUESTIONS, BECAUSE I KNOW THERE'S GOING TO BE A LOT THROWN AT YOU, AND IF WE WAIT TILL THE END, YOU MAY FORGET YOUR QUESTION.
REAL QUICK, WE'RE GOING TO GO OVER THE GRID.
WHAT IS THE ENERGY GRID? YOU HEAR THAT A LOT, ESPECIALLY PROBABLY HEARING IT NOW WITH OUR WEATHER EVENT COMING THIS WEEKEND.
WE SHOULD NOT HAVE THE SAME PROBLEMS THAT WE HAD IN 2021.
WE ARE IN MUCH BETTER SHAPE THAN WE WERE THEN.
BUT JUST TO LET YOU KNOW, THIS IS THE NATIONAL GRID.
YOU CAN SEE ERCOT IS THAT TEAL COLOR.
WE'RE SOLELY WITHIN THE BOUNDARIES OF TEXAS.
WHAT THAT MEANS IS THAT WE DO NOT HAVE OVERSIGHT FROM THE FEDERAL ENERGY REGULATORY COMMISSION.
BECAUSE WE DO NOT GO ACROSS STATE LINES, THE FEDERAL GOVERNMENT HAS NO AUTHORITY IN TEXAS ON OUR ENERGY GRID.
THE ERCOT AND THE LEGISLATURE LIKE IT THAT WAY.
WHEN YOU HERE, IF WE'D BEEN INTERCONNECTED, THE 21 STORM, WE WOULDN'T HAVE LOST POWER.
THAT'S NOT TRUE EITHER BECAUSE BIG SECTIONS OF LOUISIANA, ARKANSAS, OKLAHOMA, AND INTO KANSAS ALSO LOST POWER DURING THAT STORM, AND YOU CAN SEE THERE ON THE GRAYS, THE EASTERN INTERCONNECT.
NEXT SLIDE. WHO IS ERCOT? NO ONE EVER HEARD OF THEM BEFORE 2021 WHEN WE HAD THE STORM, NOW EVERYBODY KNOWS COT.
THEY'RE THE ELECTRIC RELIABILITY COUNCIL OF TEXAS, THEY SEE THE GRID.
THEY MAKE SURE THAT THE LIGHTS STAY ON THAT THE GRID IS RUNNING THE WAY IT NEEDS TO BE RUN.
THEY ARE OVERSEEN BY THE PUBLIC UTILITY COMMISSION, AND THE PUC AND THE ERCOT COMMISSIONERS ARE ALL APPOINTED BY THE GOVERNOR.
THEY ARE BASICALLY WHAT WE CALL THE AIR TRAFFIC CONTROLLERS OF THE ENERGY GRID.
THEY DON'T PRODUCE POWER, THEY DON'T BUY POWER.
THEY JUST TELL THE GENERATORS WE NEED MORE POWER OVER HERE, WE NEED LESS POWER OVER HERE, JUST SO THEY CAN MAINTAIN 60 HERTZ ON THE GRID AT ALL TIMES.
YOU CAN SEE ABOUT 90% OF ALL OF TEXAS IS IN ERCOT, 27 MILLION CUSTOMERS IN THE ERCOT REGION.
RIGHT NOW, THEIR RECORD PEAK WAS 85,000 MEGAWATTS, WE'RE PEAKING EVEN MORE AS AI AND BITCOIN CONTINUE TO GROW IN THE DATA CENTERS, AND THAT'S BEEN A CONCERN THAT AS THOSE DATA CENTERS GET BUILT, NOT ONLY ARE THEY ENERGY HOGS, THE WATER HOGS.
EVERYBODY'S REALLY WATCHING THAT.
THE INTERESTING THING ABOUT THE AI DATA CENTERS IS THAT THEY MAY SAY, WE MAY BUILD IT IN PARIS, TEXAS, WE MAY BUILD IT IN ODESSA, OR WE MAY BUILD IT IN CORPUS CHRISTI.
ERCOT'S BEEN COUNTING THAT THREE TIMES, EVEN THOUGH THAT COMPANY IS ONLY GOING TO BUILD IT ONCE.
THAT'S CAUSED SOME CONFUSION AS WELL WHEN ERCOT IS TRYING TO FIGURE OUT HOW MUCH ENERGY WE NEED IN THE GRID.
THEY'RE STARTING TO REALLY HOLD THOSE AI CENTERS ACCOUNTABLE AND SAY, HOW MANY ARE YOU ACTUALLY BUILDING? WE'RE ONLY GOING TO COUNT AT ONCE.
WE'RE NOT GOING TO COUNT AT THREE TIMES.
IF YOU HEARD LAST YEAR OR THE YEAR BEFORE, WHEN ERCOT WAS REALLY WORRYING ABOUT THE AI CENTERS, THEY WERE QUADRUPLING AND DOUBLE-COUNTING A LOT OF THESE AI CENTERS.
NEXT SLIDE. A LITTLE BIT OF HISTORY OF ELECTRICITY IN TEXAS.
THE FIRST POWER PLANT WAS BUILT IN TEXAS IN THE 1880S IN THE CITY OF GALVESTON.
IN THE 1890S, HOUSTON, SAN ANTONIO, EL PASO, DFW, AND AUSTIN HAVE ELECTRIC LIGHTS.
IN 1935, FDR SIGNS THE RURAL ELECTRIFICATION ACT.
THAT'S REALLY IMPORTANT BECAUSE THAT WAS THE ACT THAT SAID THAT LIGHTS NEEDED TO GET INTO THE RURAL AREAS, ESPECIALLY IN TEXAS.

THAT'S WHY YOU SEE IN 1937, GRAYSON COUNTY COOP., AND FARMERS ELECTRIC COOP., BOTH ARE FORMED THAT YEAR TO START PROVIDING ELECTRICITY SERVICES TO THE RURAL AREAS OF TEXAS.IN THE 1940S, WE HAD THE TEXAS INTERCONNECT SYSTEM, WHICH IS A LITTLE BIT BEFORE ERCOT.
IT WAS TRYING TO KEEP ALL THE DIFFERENT SYSTEMS IN ONE PLACE BACK THEN, YOU HAD THE RURAL COOPS., YOU HAD DALLAS DID THEIR OWN THING, AUSTIN DID THEIR OWN THING, AND IT GREW FROM THERE.
YOU ALL WERE INCORPORATED IN 1969, AND ERCOT FORMS IN 1970.
IN 1975, THE TEXAS PUBLIC UTILITY COMMISSION IS FORMED TO OVERSEE THIS IN 1999, DEREGULATION HAPPENS.
WE WENT FROM AT THE BOTTOM, WHICH IS STILL IN THE COOP.
THERE WAS A POWER PLANT, THE UTILITY COMPANY YOU KNEW WHO YOUR PROVIDER WAS.
THE CO-OPS STILL WORK THAT WAY.
BUT THE REST OF THE STATE, AS LONG AS THEY'RE NOT A MUNICIPALLY OWNED UTILITY LIKE GARLAND OR ARE IN A COOP, YOU HAVE YOUR CHOICE NOW AND THAT ROLLED OUT IN 2001.
WHEN YOU HAVE CHOICE, YOU CAN PICK WHOEVER IS OUT THERE IN THE MARKET THROUGH A RETAIL ELECTRIC PROVIDER.
AGAIN, YOU ALL KNOW BETTER THAN I DO, YOU'RE SERVED BY ONCORE, WHERE THERE IS CHOICE.
FARMERS ELECTRIC COOPERATIVE AND GRAYSON-COLLIN COUNTY COOPERATIVE.
BOTH OF THE COOPERATIVES ARE MONOPOLIES.
YOU DO NOT HAVE CHOICE IF YOU LIVE IN THOSE AREAS.
JUST BECAUSE PARKER WAS VERY RURAL BACK IN THE '30S, WHAT HAPPENS IS HOW THEY DECIDE WHO GETS WHAT IS WHO GETS THERE AND WANTS TO SERVE IT.
IF, FOR SOME REASON, A NEW DEVELOPMENT OR A NEW CUSTOMER COMES IN AND FARMER SAYS, I DON'T WANT IT, GRAYSON COULD SAY, WE'LL GO OUT AND WE'LL RUN THE LINE TO THEM, OR IT COULD BE THAT ONCORE HAS LINES CLOSER AND ONCORE GRAB THEM.
IT BECOMES A REAL PATCHWORK OF WHO'S GOING TO SERVE, IT SOUNDS LIKE I'M TALKING TO THE MAYOR THAT YOU ALL ARE REALLY A HUGE PATCHWORK OUT HERE.
UNFORTUNATELY, NOBODY'S GOING TO TELL YOU EXACTLY WHERE THEIR LINES RUN FOR SECURITY REASONS.
THEY DON'T WANT TO TELL YOU THAT OUR LINE RUNS HERE, AND NEXT DOOR'S LINE IS ONCORE.
SECURITY AND PROPRIETARY REASONS, THEY'RE NOT GOING TO GIVE YOU EXACT MAPS.
IT DOES MAKE IT HARDER, ESPECIALLY OUT HERE, TO TRY AND FIGURE OUT, WHERE DO I LIVE.

WE HAVE A BOARD THAT IS ELECTED FROM OUR MEMBERSHIP, AND WE JUST HAD ELECTIONS.
THOSE REPRESENTING THE NORTH TEXAS AREA ARE LOUISVILLE, HURST, LANCASTER, AND FT.
BUT WE HAVE ELECTIONS EVERY YEAR.
HALF OF THE BOARD IS UP EVERY YEAR, AND ANYONE CAN RUN ELECTED OFFICIALS OR STAFF.
WHY TCAP? WHY SHOULD PARKER BE A MEMBER? WHAT MAKES US DIFFERENT? WE'RE A NONPROFIT POLITICAL SUBDIVISION ORGANIZATION.
WE'RE ACTUALLY WRITTEN INTO THE 1999 DEREGULATION BILL.
WE POOL OVER ONE BILLION KILOWATTS OF ENERGY TO NEGOTIATE LOWER RATES, AND WHAT WE'RE DOING IS WE'RE NEGOTIATING THEM IN THE WHOLESALE MARKET.
WE DO NOT GET OUR ELECTRICITY CONTRACT IN THE RETAIL MARKET.
WE HAVE AN ATTRACTIVE LOAD PROFILE.
A LOT OF TIMES, IT'S NOT HOW MUCH ENERGY YOU USE, IT'S HOW YOU USE THE ENERGY.
FOR EXAMPLE, THE TWO GREEN GRAPHS ON THE LEFT, THOSE ARE TWO DIFFERENT MEMBERS.
YOU CAN SEE THE TOP ONE USES MORE POWER IN THE OVERNIGHT HOURS.
IT COULD BE WATER TREATMENT, WASTEWATER TREATMENT, DEFINITELY STREET LIGHTS.
THE MEMBER AT THE BOTTOM IS A SMALLER MEMBER, BUT YOU SEE THAT THEY'RE USING MORE POWER IN THE 8-5.
YOU SEE THAT BIG ARCH THERE IN THE MIDDLE.
THEY'RE USING MORE POWER IN THE 8-5 HOURS.
YOU SEE THE PEAKS AGAIN ON THE OVERNIGHT HOURS, BUT AGAIN, STILL MORE IN THE 8-5 HOURS.

WHAT HAPPENS IS IF YOU TAKE THOSE TWO GRAPHS AND OVERLAY THEM, YOU START GETTING A FLAT LINE.THE FLATTER THE LINE YOU CAN GET TO BUY A CONTRACT WITH, THE BETTER YOUR PRICING IS BECAUSE YOU CAN BUY IT IN BLOCKS, AND YOU'RE NOT HAVING AS MUCH WIGGLE IN THE GRAPH, SO TO SPEAK.
THE ERCOT ON THE OTHER SIDE IS THE BLUE LINE, AND YOU CAN SEE THAT WE'RE PRETTY FLAT, NOT QUITE THERE.
THE RED LINE IS HOW ERCOT AS A WHOLE USES POWER.
YOU CAN SEE THAT IT PEAKS IN THE 4:00-5:00, 6:00 P.M. RANGE.
USUALLY, IN THE PAST, THAT'S WHEN YOU HEAR ERCOT SAY THEY WANT ENERGY CONSERVATION.
BECAUSE THEY'RE PEAKING AND THERE'S NOT ENOUGH POWER ON THE GRID, NECESSARILY.
IT'S ALSO WHEN SOLAR STARTS RAMPING DOWN BECAUSE THE SUN'S GOING DOWN.
THE OTHER THING ABOUT OUR LOAD IS YOU CAN ALSO SEE THAT WE HAVE A LOT OF POWER THAT WE USE IN THE OVERNIGHT HOURS.
WE'RE ALSO ABLE WHEN WE GO OUT INTO THE MARKET, THEY KNOW THAT THEY CAN BUY A LOT MORE BLOCK POWER FOR US IN THE OVERNIGHT HOURS.
THEY DON'T HAVE TO FOLLOW THAT RED CURVE LIKE THEY DO FOR A LOT OF CUSTOMERS.
THAT REALLY HELPS KEEP THE TCAP PRICES LOWER.
FOR EXAMPLE, WE CALL THEM MEMBERS BECAUSE MOST OF OUR MEMBERSHIP IS CITIES, BUT WE DO HAVE OTHER LOCAL GOVERNMENT ORGANIZATIONS THAT ARE PART OF OUR GROUP.
BUT IF THOSE TWO MEMBERS ACTUALLY USE THE EXACT SAME AMOUNT OF ENERGY, I KNOW THERE ARE DIFFERENT GRAPHS.
THE BOTTOM ONE IS MUCH SMALLER.
BUT LET'S SAY THEY USE THE EXACT SAME AMOUNT OF ENERGY.
THEY WANTED THE EXACT SAME CONTRACT ON THE EXACT SAME DAY FOR THE EXACT SAME LENGTH OF TIME.
THE MEMBER ON THE TOP IS GOING TO GET A BETTER CONTRACT THAN THE MEMBER ON THE BOTTOM, AND IT'S BECAUSE OF HOW THEY USE THE POWER.
THEY KNOW THAT THEY'RE GOING TO USE MORE IN THAT OVERNIGHT HOUR.
THE MEMBER AT THE BOTTOM, BECAUSE THEY'RE USING MORE POWER WHEN EVERYBODY ELSE IS USING POWE, R IS GOING TO PAY A PREMIUM.
THAT HELPS, AND WE'RE ABLE TO FLATTEN EVERYBODY OUT AND GET THEM A BETTER PRICE BECAUSE WE AGGREGATE EVERYBODY TOGETHER. YES.

FOR WE CHARGE AN AGGREGATION FEE.
IT'S ON YOUR BILL. IT'S 1.2 MILL A CENT PER KILOWATT.
FOR THAT, YOU GET ALL THESE ADDITIONAL SERVICES.
THE BROKERS DO NOT PAY TCAP A FEE TO BRING THEM THE BUSINESS.
A LOT OF THE BROKERS WILL TELL YOU THAT THEY'VE GONE TO THE MARKET, THEY'VE SEARCHED THE MARKET, AND THEY'RE GOING TO MAKE SURE THAT THEY'RE FAVORED RETAIL ELECTRIC PROVIDER IS THE ONE THAT COMES UP BECAUSE THEY GET FEES OFF OF THEM.

TCAP AS A WHOLE PAYS ABOUT $2.2 MILLION IN GROSS RECEIPTS TAX, SO WE'RE STILL WE'RE GOING TO AGAIN INTRODUCE IT NEXT SESSION.
WE THOUGHT THIS SESSION WOULD BE GOOD SINCE THE STATE HAD SO MUCH MONEY, BUT NOT SO MUCH.
THEN RIGHT NOW WE'RE WORKING WITH THE PUBLIC UTILITY COMMISSION ON COMMERCIAL SERVICE STANDARDS.
THERE ARE CUSTOMER SERVICE STANDARDS FOR RESIDENTIAL CUSTOMERS.
THE PEC IS VERY CONCERNED ABOUT RESIDENTS, OF COURSE, IT'S VERY COMPLICATED TO TRY AND BUY AN ELECTRIC BILL.
YOU CAN PAY FOR A BROKER TO DO BUT A LOT OF RESIDENTS ARE ON THEIR OWN TRYING TO FIGURE IT OUT.
UNFORTUNATELY, ON THE COMMERCIAL SIDE, THE LEGISLATURE FELT, WELL, COMMERCIAL BUSINESSES HAVE ALL THE INFORMATION, THEY'VE GOT STAFF, THEY CAN FIGURE IT OUT.
THEY DIDN'T TAKE INTO CONSIDERATION SMALL CITIES.
WE HAVE CITIES IN OUR MEMBERSHIP WITH POPULATIONS OF 126 PEOPLE.
WHICH HAS A PART TIME MAYOR AND MAYBE TWO STAFF MEMBERS.
THESE ARE NOT ORGANIZATIONS THAT HAVE THE EXPERTISE, THE MANPOWER, OR THE TIME TO BE WORRYING ABOUT ELECTRICITY CONTRACTS.
THAT IS ANOTHER BENEFIT OF BEING IN TCAP IS WE'LL TAKE CARE OF ALL OF THAT.

BUT THE GOOD NEWS IS THAT YOU GET TO TAKE ADVANTAGE OF WHEN PRICES FALL.
YOU'RE NEVER THAT FAR OUT OF THE MARKET.
I WAS TALKING TO A CITY TODAY, WHO'S LOOKING AT JOINING TCAP, AND THEY'VE GOT ONE OF THOSE PRE-21 RATES.
THEY'RE AT A FOUR CENT RATE, AND NOW THEY'RE COMING INTO A EIGHT AND NINE CENT MARKET, AND THAT'S A HUGE INCREASE FOR ANY ONE CITY TO TAKE ON, BUT THEY DON'T HAVE A CHOICE.
WITH THE WAY WE'RE DOING THINGS, YOU'RE BELOW THE CURRENT MARKET RATE, BUT YOU'RE IN THE MARKET, YOU'RE NEVER GOING TO BE WAY OFF.
WHEN PRICES FALL, YOU GET TO TAKE ADVANTAGE OF THAT FOR THE SAVINGS AS WELL BECAUSE ONCE YOU LOCK IN A LONG TERM CONTRACT, YOU CAN'T TAKE ADVANTAGE OF WHEN PRICES FALL, AND WE SAW THAT WITH FRACKING.
TCAP WAS LOCKED INTO A CONTRACT AT THE TIME.
FRACKING HAPPENED AND RATES DROPPED BY 50%.
WE WENT FROM A SEVEN CENT MARKET TO A THREE CENT MARKET, AND OUR MEMBERSHIP WAS GOING, WE NEED THIS $0.03, AND WE'RE LIKE, WE'RE IN A CONTRACT, PAYING TO GET OUT OF IT'S MUCH TOO EXPENSIVE.
THEN YOU JUST HAVE TO SIT AND WAIT AND BIDE YOUR TIME.
WE'RE STRATEGIC PURCHASING, WE DON'T HAVE TO DO THAT. A COUPLE OF THINGS.
CONTRACTS ARE EXEMPT FROM BIDDING.
STATE LAW DOES NOT REQUIRE YOU TO BID A CONTRACT.
THE PROBLEM IS, THE REASON IS YOU HAVE TO UNDERSTAND THE FINE PRINT IN THE CONTRACT AND HOW IT CAN AFFECT THE RATE, JUST BECAUSE YOU DO AN RFP SHEET AND THIS LOOKS LIKE THE LOWEST RATE.
THERE COULD BE SOME LANGUAGE IN THE CONTRACT THAT COULD NEGATE THAT LOW RATE OR ALL OF A SUDDEN YOU DO SOMETHING IN PARKER, LET'S SAY YOU TEAR DOWN CITY HALL AND YOU BUILD SOMETHING BIGGER, AND ALL OF A SUDDEN, THE PROVIDER COULD SAY, WELL, YOU DELETED THAT METER SO THAT MEANS WE CAN OPEN UP THE CONTRACT AND RAISE YOUR RATES.
THAT'S WHY THEY EXEMPT IT FROM BIDDING.
A LOWER RFP PRICE COULD ACTUALLY BE HIGHER, HOW THE CONTRACT IS WRITTEN.
DIFFERENT BROKERS AND REPS CALL THE SAME THING DIFFERENT NAMES.
THE OTHER THING IS OFF THE SHELF CONTRACTS DON'T HELP CITIES.
YOU HAVE A THE CITY HAS A COMMERCIAL ENERGY SERVICE AGREEMENT.
THEY HAVE COMMERCIAL AGREEMENTS AND THEY HAVE RESIDENTIAL AGREEMENTS.
IF THE CITY WENT OUT ON THEIR OWN, THE COMMERCIAL AGREEMENT YOU WOULD GET IS THE SAME THING THEY HAND TO A MCDONALD'S OR WALMART DOESN'T TAKE INTO CONSIDERATION ANYTHING THAT'S FOR CITIES.
WE HAVE OUR OWN CONTRACT THAT WE GO OUT INTO THE MARKET BECAUSE WE'RE SO LARGE AND THEY WANT OUR BUSINESS, THEY AGREE TO WHAT WE'VE PUT IN THE CONTRACT TO HELP PROTECT CITIES.

WE'RE HOPING TO GET SOME OF THAT ON THE COMMERCIAL BUSINESS SIDE FOR ELECTRICITY CONTRACTS BECAUSE IT'S CRAZY WHAT WE'RE SEEING THE BROKERS TELLING OUR MEMBERS, WHAT THEY'RE SENDING OUR MEMBERS.
SOME OF THEM ARE OUTRIGHT BREAKING SOME OF THE RULES.
THE PROBLEM IS THERE'S ONLY A HALF A PAGE OF RULES THAT BROKERS HAVE TO LIVE BY.
WHAT'S INTERESTING THOUGH WHEN YOU ASKED THAT QUESTION, I KNOW THAT WAS A LOT TO GET TO THIS.
THE PROBLEM WITH THESE OTHER RATES IS THEY'RE NOT AS BIG.
I WOULD SAY MAYBE ANCILLARY CONGESTION, ALL THESE CHARGES FROM ERCOT PROBABLY LESS THAN 10% OF YOUR BILL, WHERE THE BIG THING IS COMING FROM THE ONCOR CHARGES.
ONCOR IS ACTUALLY ALL THE TDU.
AGAIN, THE MONOPOLY OR THE CO-OPS ARE VERY DIFFERENT, BUT I'M HEARING FROM SOME OF OUR MEMBERS THAT HAVE BOTH ONCOR AND THE CO-OPS, THAT THE CO-OP RATES ARE ABOUT WHAT THE TCAP RATES ARE AS WELL, THAT THE LINE CHARGES.
THE ONCOR CHARGES ARE MAKING UP ANYWHERE FROM 50-75% OF THE ENTIRE BILL.
WE'VE GOT A COUPLE OF OUR SMALLER CITIES, 75% OF THEIR BILL IS STRICTLY ONCOR.
ONCOR DID ASK FOR A RATE INCREASE, AND OUR ATTORNEYS HAVE BEEN AT THE PUC FIGHTING.
THERE HAS BEEN A SETTLEMENT AGREEMENT.
WE HAVEN'T SEEN WHAT THAT MEANS YET.
ONE OF THE THINGS THAT ONCOR WAS DOING WAS TRYING TO RAISE STREET LIGHT CHARGES BY 51%.
I'M HOPING THAT SETTLEMENT WILL COME OUT SOON BECAUSE WE'VE GOT BUDGET ESTIMATES TO DO FOR YOU ALL.
BUT THE PROBLEM IS, SINCE WINTER STORM MURI AT THE LEGISLATURE, THE PUC, TO BE HONEST, IT'S BEEN A BLANK CHECK.

WE'VE PUT PRESSURE ON ONCOR A COUPLE OF YEARS AGO BECAUSE OF SOME BAD SERVICE UP HERE IN THE METROPLEX.
ONCOR HAD, LOCK BOXED OUT AT REC CENTER BECAUSE THEY MESSED UP THE ESI ID NUMBER AND WENT TO THE WRONG ADDRESS.
THEY TOOK A TRAFFIC LIGHT OUT OF AN INTERSECTION THAT SEE 65,000 PEOPLE AT RUSH HOUR, TOOK THE METER BOX OUT, SO THE TRAFFIC SIGNAL DIDN'T WORK.
WE GATHERED OUR MEMBERSHIP UP AND REALLY PUT SOME PRESSURE ON ONCOR TO MAKE SURE THAT THOSE ISSUES DIDN'T HAPPEN, THAT THEY NEEDED TO LOOK AT HOW THEY WERE TREATING CITY ACCOUNTS BETTER.

JUST A LITTLE BIT OF THE BACKGROUND.
I THINK EVERYBODY IS FULLY AWARE THAT LOUIS LANE NEEDS AN OVERHAUL AND THERE'S VERY LITTLE DISAGREEMENT ON THAT FACT.
WHAT WE'VE BEEN DEALING WITH BEHIND THE SCENES FOR THOSE OF YOU WHO AREN'T FULLY AWARE IS LOUIS LANE HAS BEEN FRAUGHT WITH A CRISS-CROSSING OF JURISDICTIONAL BOUNDARY ISSUES.
IT GOES FROM THE CITY OF PARKER TO THE CITY OF LUCAS, AND THERE'S A LITTLE [INAUDIBLE] IN THERE THAT ONCE BELONGED TO THE COLLIN COUNTY.
THAT'S WHAT WE'VE BEEN DEALING WITH OVER THE PAST FEW MONTHS, AS HEADED UP BY OUR COUNCIL MEMBER SHARPE, MYSELF IN THE DISCUSSIONS WITH CITY MANAGER AND LUCAS AND THEIR MAYOR, DUSTY KUYKENDALL.
WE'VE COME TO THIS SOLUTION AFTER A LOT OF BACK AND FORTH.
THIS ONE IS PRETTY SIMPLE. IT'S STRAIGHTFORWARD.
IT RESOLVES A LOT OF THE ISSUES THAT WE ARE FACING.
ESSENTIALLY, PARKER IS GOING TO TAKE FULL CONTROL OVER LOUIS LANE THROUGH A SERIES OF ANNEXATIONS AND DISANNEXATIONS, AND LUCAS WILL DO THE SAME FOR WEST LUCAS ROAD THROUGH THE SAME PROCESS.
THIS IS GOING TO CLEAN UP OUR JURISDICTIONAL ISSUES THAT WE HAVE HAD.
IT'S GOING TO ALLOW FULL AUTHORITY, ALLOW US TO HAVE ESSENTIALLY PLAY IN OUR OWN SANDBOXES AS HOW IT'S BEEN PUT GOING FORWARD.
I DON'T THINK THIS IS ANY SURPRISE TO ANYONE IN THIS ROOM WHO SHOWED UP WHO CARES ABOUT THIS ISSUE.
THIS IS FROM A DAY WHERE WE PATCHING SOME OF THE POTHOLES, BUT YOU CAN SEE THERE'S JUST SECTIONS THERE THAT ARE JUST IN DIRE NEED OF REPAIR.
SOME OF THE KEY BENEFITS OF THIS APPROACH IS IT ALLOWS US TO MOBILIZE ON THIS PROJECT WITH ANDERSON ASPHALT VERY QUICKLY AS EARLY AS MARCH 2026, IF THIS IS APPROVED.
OF COURSE, WE WILL HAVE TO BRING FORTH THE CONSTRUCTION CONTRACT FOR REVIEW AND CONSIDERATION.
THAT CAN BE DONE AS EARLY AS THE NEXT CITY COUNCIL MEETING.
ONE OF THE ISSUES THAT WE WERE GETTING BOGGED DOWN IN IS THIS IDEA OF POTENTIAL MONETARY EXCHANGES BETWEEN THE TWO DIFFERENT CITIES.
THIS ELIMINATES THE DISPUTES THAT WE WERE HAVING THERE.
IT SIMPLIFIES OUR CONSTRUCTION MANAGEMENT, FUTURE WARRANTY OBLIGATIONS.
THERE WAS A LOT OF DISCUSSION ABOUT IF WE DO GO WITH A SINGLE CONTRACTOR FOR THE OVERALL, WHO'S GOING TO BE RESPONSIBLE IF THERE'S A DEFECT IN THAT? THIS STREAMLINES THAT.
IT ALSO AVOIDS THE ESCALATING CONSTRUCTION COSTS WITH FURTHER DELAYS.
OVERALL, THIS IS GOING TO SAVE US APPROXIMATELY $85,000 FROM

THE VOLUME DISCOUNT WE'RE GETTING WITH ANDERSON ASPHALT BECAUSE OF THE DUBLIN CONTRACT, THE ROAD PAVING THAT'S ONGOING OVER THERE.BECAUSE THEY CAN QUICKLY MOBILIZE TO ANOTHER PROJECT, THEY WERE ABLE TO GET THIS AT A DISCOUNT, THEIR TONNAGE FOR THEIR SQUARE YARDS.
WHAT WE DID ON CALCULATIONS, THE DIFFERENCE BETWEEN THE LINEAR FOOT ON LUCAS AND THE LINEAR FOOT ON LEWIS THAT WE WERE RESPONSIBLE FOR, THE LIABILITY DIFFERENCE BETWEEN THE TWO ROADS REALLY EQUATED TO ABOUT LESS THAN 5%, SO THAT'S WHY WE WERE ABLE TO JUSTIFY NO EXCHANGE IN FINANCING BETWEEN THE TWO DIFFERENT CITIES.
IT ALSO ELIMINATES THE HIDDEN ADMINISTRATIVE COSTS FROM JOINT MANAGEMENT.
WE TALKED A LITTLE BIT ON THAT EARLIER.
THIS ALSO ACCOUNTS FOR OPPORTUNITY COST ASSOCIATED WITH SPENDING ADDITIONAL STAFF, ADDITIONAL LEGAL TIME NEGOTIATING ON POINTS THAT HAVE A LARGE DISPARITY BETWEEN THE TWO MUNICIPALITIES.
A COUPLE OF OTHER POINTS TO JUST HIT ON HERE, THE CITY OF PARKER, WE HAVE A GREATER INTEREST IN LOUIS LANE, AND THE OPPOSITE IS THE CASE FOR LUCAS ROAD.
AT LEAST 75% IS WHAT WE'RE ESTIMATING THE VEHICULAR TRAFFIC ON LOUIS LANE IS ATTRIBUTABLE TO THE CITY OF PARKER, AT LEAST AS OF TODAY.
THEN JUST SOME BOTTOM LINES FOR YOU HERE, THE TIMELINE, IF THIS MOU WERE TO BE APPROVED, THIS DOES PAVE THE PATH FOR CONSTRUCTION TO BEGIN QUICKLY.
SPRING 2026, WE'VE GOT A COUPLE OF THINGS THAT WE NEED TO DO, HOUSEKEEPING WISE.
SAME FOR ANDERSON CONSTRUCTION PAVING.
BUT THEY THINK THIS IS A REASONABLE TIMELINE.
AFTER THIS WOULD BE APPROVED, IF THAT IS THE DIRECTION THAT COUNCIL WANTS TO GO, OUR CITY ATTORNEYS WOULD BOTH BE WORKING TOGETHER TO WORK THROUGH THE ANNEXATIONS AND DISANNEXATIONS.
AS I'VE MENTIONED TO YOU BEFORE, I DON'T THINK ALL THE INK ON THE PAPER OF THOSE HAS TO BE DRY BEFORE WE CAN START PUTTING THE PIECES TOGETHER FOR CONSTRUCTION, BUT I WILL LEAVE THAT UP TO YOU.
BOTTOM LINE, THIS IS A PRACTICAL SOLUTION.
IT GETS US BOTH OUT OF LONGSTANDING NEGOTIATING STALEMATE.
IT ESTABLISHES CLEAR AUTHORITY FOR BOTH OF OUR POLICE DEPARTMENTS GOING FORWARD.
THEY'LL KNOW EXACTLY WHERE THE LINES ARE DRAWN.
DON'T HAVE TO WORRY ABOUT, THAT'S LUCAS, THIS IS PARKER, ET CETERA.
IT MOVES THESE CRITICAL INFRASTRUCTURE PROJECTS THAT BOTH CITIES ARE WORKING ON FORWARD AFTER YEARS OF DELAYS.
I JUST WANT TO ADD ONE POINT TO THIS THAT I THINK MANY OF THE CITIZENS ARE NOT AWARE OF.
OUR CURRENT OWNERSHIP OF LUCAS ROAD IS GOING TO BE EXPANDED AT SOME POINT IN THE NEAR FUTURE, SO BY US SWITCHING, WE ARE GETTING OUT OF THAT LIABILITY.
THAT'S WHY KENT WAS SAYING THE COST DIFFERENCE IS WITHIN 5% OF EACH OTHER. THANK YOU FOR CLARIFYING.

LUCAS IS TAKING CHARGE OF ALL OF LUCAS ROAD.
SOME OF THE LAND ADJACENT TO EACH OF THOSE PIECES OF PROPERTY WOULD BELONG TO THE OTHER CITY.
THERE'S A CLAUSE IN HERE THAT ALLOWS IF IT'S A LUCAS DEVELOPMENT, PARKER WILL HAVE THE OPPORTUNITY TO REVIEW IT IF IT IMPACTS LOUIS LANE, AND IF IT'S A LUCAS DEVELOPMENT THAT WOULD IMPACT PARKER, PARKER COULD DEVELOP.
THEY COULD EACH OVERSEE EACH OTHER'S PROPERTY DEVELOPMENT AND APPROVE IT FOR BOTH DRAINAGE PURPOSES, CONNECTIVITY, AND EVERYTHING ELSE. I THINK THAT'S IMPORTANT.
THERE WAS ONE CLAUSE IN HERE, IT'S CLAUSE F TERMINATION OF THE AGREEMENT.
WHEN I FIRST READ IT, IT SAID TERMINATION, THE AGREEMENT MAY BE TERMINATED.
I WAS THINKING, WHY WOULD WE EVER WANT TO TERMINATE THIS? I WOULDN'T WANT TO.
I HAD OVERLOOKED THE FACT THAT IT SAID MUTUAL WRITTEN CONSENT.
