KING'S CROSSING PHASE 5, 36 LOTS, 49.583 ACRES.

IT IS ANOTHER PHASE OF KING'S CROSSING, AND IT'S.

HOW'S THE DRAINAGE? PERFECT. [INAUDIBLE] ON PAPER, ANYWAY.

ALL RIGHT. WE'LL SEE WHAT IT RAINS, RIGHT? RIGHT. HAS IT BEEN HAS IT BEEN TESTED BEEN TESTED RECENTLY? ALL THE DRAINAGE IN THE CITY IS BEING TESTED RIGHT NOW.

AND SO THAT PHASE WILL BE DICTATED ALL BY DRAINAGE AND HOW THE WATER CARRIES ACROSS IT BECAUSE IT IMPACTS IT INCLUDES MUDDY CREEK. SO THERE'S A MUCH LARGER DRAINAGE STUDY TO BE DONE FOR THAT NEXT.

SO SOME CONSIDERATION UP HERE [INAUDIBLE].

ARE THERE ANY PARTICULAR ITEMS? I KNOW, JOE, YOU'VE HAD A COUPLE THAT HAVE BEEN [INAUDIBLE].

IF YOU COULD JUST ENLIGHTEN US ON [INAUDIBLE].

ON THE PLAT. SHE POINTED TO THE ENGINEERING, [INAUDIBLE] ON THE APPLICATION [INAUDIBLE]

THE ACREAGE THAT'S ON THE PLAT THE 49.583 AND SOME OF THE OTHER DOCUMENTS THAT WERE IMPACTED INDICATED THAT THAT WAS 51.265 ACRES.

SO AND WITH THE PLAT HAS BEEN STRAIGHTENED OUT BECAUSE IT READS.

[INAUDIBLE] AND SAID THAT 1.265 INCHES IN THE BEGINNING IT SAYS BEING KNOWN AS THE 49.583 ACRES, WHICH IS THE CORRECT AMOUNT.

AND WE'RE JUST TRYING TO [INAUDIBLE].

THE MOST RECENT TRACT.

THAT WAS THE TOTAL ACREAGE OF THE TRACK THAT WAS TRANSFERRED INTO THIS OWNERSHIP ENTITY AND NOT ALL OF THE LAND.

AND THAT OWNERSHIP ENTITY IS BEING PLATTED.

AND THEN THE OTHER [INAUDIBLE] I HAD WAS THAT THE LOT NUMBERS WERE HARD TO TRACK ON [INAUDIBLE] IN THE LETTER FROM MURDOCH'S OFFICE.

YEAH. YEAH. THOSE ITEMS HAVE [INAUDIBLE].

ITEM ONE HAS BEEN RESOLVED, BUT I'VE GOT A DETAIL SHEET 12 AND IDENTIFIES THAT . WHAT THE ENGINEER IS LOOKING FOR IS TO MAKE IT FOOLPROOF FOR THE BUILDER.

SO HOW DO YOU INSTALL THESE FOUR CULVERTS IN THE CORRECT WAY? AND IF WE PUT IT ON THE CONSTRUCTION PLAN, WHICH THE CITY HAS A COPY OF, THE ENGINEER HAS A COPY OF THE BUILDER HAS A COPY OF, IT SHOULD BE FOOLPROOF WHEN IT'S INSTALLED BECAUSE EVERYONE SEES IT.

SOMETIMES THE DETAILS ARE GOOD AS LONG [INAUDIBLE].

AND THEN WE'RE WORKING ON AN AGREEMENT BETWEEN THE CITY AND THE DEVELOPER OR.

A SHORT SECTION OF ROAD THAT'S NOT GOING TO BE COMPLETED THE 40 FEET OR SO.

IT'S 40 FEET. SO THE CURRENT ADMINISTRATION THIS IS I'M GOING TO TELL YOU HOW TO BUILD A WATCH.

THE CURRENT ADMINISTRATION USE ANY WATERWAY THAT HAS ANY HISTORICAL SIGNIFICANCE, MEANING IT'S BEEN THERE LONGER THAN 20 OR 30 YEARS, IS A NAVIGABLE WATERWAY.

SO YOU CAN DRIVE YOUR BOAT UP IT AND SHIP COTTON DOWN IT.

NOT MY RULE. YEAH, THE CREEK THAT TRAVELS IS APPROXIMATELY THREE AND ONE HALF FEET WIDE FROM A POND THAT WAS CREATED TO HAVE WATER FOR CATTLE DOWN THE MUDDY CREEK IS NOW A NAVIGABLE WATERWAY [INAUDIBLE].

IF YOU HAVE VERY SMALL [INAUDIBLE].

CORRECT. AND BECAUSE OF THAT, IF YOU IF YOU BUILD A ROADWAY ALL THE WAY TO THE PROPERTY LINE, YOU INFRINGE UPON THE OUTER BOUNDARIES OF THAT NAVIGABLE WATERWAY, WHICH CREATES A MUCH LARGER HURDLE FOR MUNICIPALITY AND THE CONSTRUCTION PROCESS, IT HAS TO BE DONE WHEN THE ROADWAY IS EXTENDED TO THE NEXT PHASE.

SO THE CONSENSUS IS DON'T OPEN THAT CAN OF WORMS AT THE MOMENT.

THAT'S AN INTERESTING I DON'T THINK IN ALL THE TIME THAT I'VE SET SAT HERE, I DON'T THINK I'VE HEARD THAT [INAUDIBLE].

THAT'S EXACTLY RIGHT. SO THIS IS THIS COMES UP TIME AND TIME AGAIN, AGAIN.

ALL OF A SUDDEN THE ADMINISTRATION WILL CHANGE THEIR MIND.

SO IT GOES BACK AND FORTH.

SO WHAT IS THE AGREEMENT? WE DON'T HAVE IT. WE HAVEN'T FINALIZED THAT YET.

WE'RE STILL WORKING ON THE AGREEMENT.

BUT WHAT WE'RE LOOKING AT IS SOMETHING A COMMITMENT FROM THEM TO COMPLETE THAT PROJECT AS PART OF THE NEXT PHASE OR ASK FOR MONEY SO THAT SOMEBODY ELSE CAN.

AND YOU DON'T YOU DON'T WANT TO BUILD A BRIDGE OVER THERE.

WE DON'T WANT TO BUILD A HALF A BRIDGE RIGHT NOW.

YOU CAN'T YOU CAN'T BUILD HALF A BRIDGE BECAUSE WE DON'T CONTROL THE OTHER SIDE OF THE WATERWAY AND YOU CAN'T DEDICATE IT TO THE CITY.

SO IT'S AN ENGINEERING AND MUNICIPAL CONUNDRUM.

SO WHAT'S TYPICALLY DONE IN OTHER MUNICIPALITIES IS YOU TIE THE AGREEMENT TO THE FINAL PLAT SO YOU GET ALL THE WAY THROUGH THE CONSTRUCTION PROCESS AND YOU UNDERSTAND WHAT'S GOING TO HAPPEN ON THE OTHER SIDE OF THE PROPERTY.

AND AT THAT POINT IN TIME, IF THE DEVELOPER OF ONE SIDE DOES NOT CONTROL THE OTHER SIDE, THE DEVELOPER WILL ESCROW FUNDS TO BUILD THAT ROADWAY.

AND THAT'S WHAT WE'RE WORKING THROUGH.

THERE'S JUST WITH THE STAFFING CHANGES, THERE'S BEEN HURDLES OF GETTING IT DONE.

SO THE ROADWAY [INAUDIBLE] NO.

SO WE'RE JUST GOING TO SAY [INAUDIBLE].

IT'S OUTSIDE OF THE PLAT AREA RIGHT NOW.

YEAH. SO IT'S INTENTIONALLY OUTSIDE OF THE PLATTED AREA SO THAT IT'S NOT PUBLICLY DEDICATED.

AND WHAT I SEE IS [INAUDIBLE].

IF YOU LOOK AT THE [INAUDIBLE] YOU GO SOUTH, 31 THROUGH 27, YOU GO ALL THE WAY OVER TO WHERE THE CIRCLE IS AND YOU GOT 28, 27, 30, 31. AM I MISSING SOMETHING HERE? [INAUDIBLE] ARE YOU LOOKING AT WHERE IT GOES 28 AND THEN JUMPS DOWN TO 25 24.

NO, I THINK WE'LL WORK THAT OUT ADMINISTRATIVELY.

WE DON'T HAVE ANY SIGNIFICANT ISSUES OR OBJECTIONS.

SHOULD WE RECOMMEND THIS FOR APPROVAL? I RECOMMEND THAT WE APPROVE PERFORMANCE FOR THE CITY COUNCIL KING'S CROSSING PHASE 5 [INAUDIBLE] PROVIDED.

YES. SO WE'RE WORKING THROUGH THAT.

THAT'S TOMORROW MORNING CONVERSATION THAT WE HAVE.

AND I THINK THAT WORKED OUT.

WE NEED TO MEET ON SCHEDULING.

AND JUST WHILE WE'RE HERE, I KNOW WE SAID WE WOULD COME BACK AT SOME POINT.

THE KING'S CROSSING PHASE THREE, WHICH WAS RECOMMENDED FOR APPROVAL TO COUNCIL BACK IN FEBRUARY OF LAST YEAR.

A YEAR AGO, COUNCIL APPROVED IN MARCH AND WE WERE WAITING ON THE FEMA TO ISSUE THE LETTER MAP [INAUDIBLE] FOR THOSE LOTS. AND FEMA ACTUALLY ISSUED THE LETTER OF MAP REVISION THIS LAST WEEK.

AND SO THAT TOOK A YEAR.

BUT THE FEDERAL GOVERNMENT IS FINALLY DONE AND WE CAN FINALLY BUILD ON ALL THE LOTS.
